Ingenium Technologies Corporation Privacy Statement

Thank you for visiting the website ("Site") of Ingenium Technologies Corporation ("Ingenium"). Ingenium has created this privacy statement ("Privacy Statement") so that you can understand how Ingenium handles information that is submitted to or otherwise gathered by Ingenium in connection with your visits to and use of the Site (collectively, the "Information"). By using the Site, clicking the "Submit" buttons on our forms and/or accessing any of Ingenium’s services, you consent to the terms and conditions contained in this Privacy Statement. Subscribers to Ingenium’s services are also subject to the terms and conditions of the written agreement that such subscribers have entered into with Ingenium.

Collection of information

How Ingenium uses information; Transfers to affiliates

Ingenium collects and uses Information for the purposes of providing you with Ingenium services to which you have subscribed, and to send you information about other Ingenium services that may be of interest to you in the future. Ingenium may also transfer Information to its Affiliates who may utilize the Information in accordance with, and subject to the terms of, this Privacy Statement. For the purposes of this Privacy Statement, "Affiliates" means entities that, directly or indirectly, control, are controlled by or under common control with Ingenium, where "control", "controlled by" and "common control" mean the possession, directly or indirectly, of the power to direct, or cause the direction of, the management policies of an entity, whether through the ownership of voting securities, by contract or otherwise.

Third-party sites; Transfers of information to third parties

The Site may link to or integrate with other websites. The privacy and data collection practices on any linked or integrated websites are entirely separate from Ingenium and are not covered by this Privacy Statement. Ingenium is not responsible for the privacy practices or the content of these linked or integrated websites, and you should review the privacy statements on these websites prior to providing such websites with any information.

Except as provided above with respect to transfers of Information to its Affiliates, Ingenium will not share your Information with third parties except: (i) as provided in this Privacy Statement; (ii) with your prior consent; or (iii) as required by law. Please note that once your Information is shared with a third party (other than Ingenium’s Affiliates as provided above), it becomes subject to the information use and sharing practices of that third party and this Privacy Statement will not restrict the use or sharing of your Information by such third party.

Ingenium will not share your Information with third parties except: (i) as provided in this Privacy Statement; (ii) with your prior consent; or (iii) as required by law. Please note that once your Information is shared with a third party, it becomes subject to the information use and sharing practices of that third party and this Privacy Statement will not restrict the use or sharing of your Information by such third party.

As part of the provision of Ingenium’s services to you, and in connection with Ingenium’s and its Affiliates’ marketing and promotional efforts, third parties may have access to your Information. For example, Ingenium and its Affiliates may utilize third-party hosting, network and service providers.

Ingenium and its Affiliates may transfer your Information in the event that Ingenium, its Affiliates and/or their respective assets are acquired by or merged with or into one or more other companies in one or more related or unrelated transactions.

Access to your personal information

You may request to view your Personal Information in Ingenium’s and its Affiliates’ records at any time and may update your Personal Information by contacting us via the email or postal address listed below. You may also contact us to request removal of your Personal Information from the records of Ingenium and its Affiliates. In addition, you always have the option to tell us not to send you information about other services of Ingenium and its Affiliates.

Security

Ingenium has implemented certain measures that are designed to decrease the likelihood that third parties will have unauthorized access to and/or use of your Information. Notwithstanding the foregoing, you should be aware that these measures may not ensure the security of your Information or prevent unauthorized third-party access and/or use of your Information. You acknowledge that you assume all of the risks of, and that Ingenium will not be responsible or liable to you for, any unauthorized access to and/or use of your Information.

How long we keep the information

Subject to your right to request the removal of your Personal Information from the databases of Ingenium and its Affiliates, Ingenium and its Affiliates will have the right to store and utilize your Information in perpetuity.

Changes to this privacy statement

This Privacy Statement is effective September 28, 2005 and may change from time to time. All changes will be posted on the Site. Your continued use the Site and/or the services of Ingenium and/or its Affiliates following the posting of such changes shall constitute your acceptance of such changed Privacy Statement.

Your California privacy rights

The law of the State of California permits Ingenium’s visitors from such State to request certain information regarding Ingenium’s disclosures, if any, of personally identifiable information of such visitors to third parties (including Ingenium’s Affiliates). To make such a request, please contact Ingenium at the email or postal address below and include your name and the address to which you would like us to respond. We will attempt to provide you with the requested information within thirty days of receipt of your request.
